Rep. Andy Biggs Argues That Mayorkas Broke Law, Should Be Impeached

The Biden administration’s Division of Homeland Safety is violating U.S. immigration regulation, border safety and immigration specialists say.

“The U.S. Structure requires the administration to ‘take care that the immigration and border safety legal guidelines be faithfully executed.’ It’s clear to me, and to tens of millions of People, that the Biden administration has failed to take action,” Chad Wolf, former performing homeland safety secretary, testified Wednesday at a Home subcommittee listening to.

“In all candor, the Biden administration is the primary administration, of both political celebration, to intentionally take steps to decrease the safety alongside our southern border,” Wolf stated, including that in his opinion, “new management is required” on the Division of Homeland Safety.

In the course of the listening to by the Home Judiciary immigration subcommittee, Rep. Andy Biggs, R-Ariz., questioned Wolf and two different witnesses on DHS’ dealing with of America’s borders and whether or not Homeland Safety Secretary Alejandro Mayorkas, appointed by President Joe Biden, had violated the regulation.

Directing his inquiries to Steven Bradbury, a distinguished fellow at The Heritage Basis, Biggs requested in rapid-fire vogue whether or not Mayorkas had violated federal legal guidelines governing immigration and border safety. (The Each day Sign is the information outlet of The Heritage Basis.)

“Mr. Bradbury, on the path of Secretary Mayorkas, DHS launched and continues to launch, tens of hundreds of aliens each month into the U.S. by mass parole, and now categorical parole,” Biggs stated, earlier than asking, “Is that this a violation of regulation?”

“Sure, it violates INA Part 212(d)(5)(a),” Bradbury stated, referring to the Immigration and Nationality Act.

“Secretary Mayorkas can also be mass-paroling aliens he himself characterizes as refugees or asylum-seekers with out demonstrating that there are compelling causes requiring that that individual alien could also be admitted by parole quite than going by the USRAP [United States Refugee Admissions Program] course of for refugee admissions. Is {that a} violation of regulation?” Biggs requested Bradbury.

“Sure, it’s a violation of Part 212(d)(5)(b),” Bradbury replied.

Biggs continued, questioning Bradbury on Mayorkas’ failure to vet unlawful aliens being paroled into the U.S. and the Biden administration’s use of the CBP One app to “funnel these unlawful migrants to the U.S. ports of entry alongside our southern border.”

With every query, Bradbury answered within the affirmative that Mayorkas had violated the regulation.

Biggs then returned to query Wolf, asking whether or not Mayorkas “is violating the regulation deliberately, willfully, or is it just a few oversight on his half?”

“So, I’m going to should guess,” Wolf stated. “I feel it’s all the above. I feel they know precisely what they’re doing [in DHS].”

Biggs requested the identical query of Joseph Edlow, former performing director of U.S. Citizenship and Immigration Companies, which is a part of DHS.

“Do you imagine that what he’s doing is intentional [and] willful, or is it simply, he’s simply an incompetent buffoon and might’t study his classes?” Biggs requested Edlow.

“I don’t assume he’s incompetent, Congressman,” Edlow answered. “Wanting on the memos, wanting on the departmental actions, the regulatory actions—that is all half and parcel of an intentional motion.”

Biggs agreed, including that it’s “long gone time” for Mayorkas “to be impeached.”

Biggs didn’t ask any questions of the fourth witness, Aaron Reichlin-Melnick, coverage director on the American Immigration Council, a nonprofit advocacy group shaped in 1987 by immigration attorneys.

Rep. Pramila Jayapal, D-Wash., dismissed Republicans’ calls to question Mayorkas as “ridiculous” throughout her opening assertion.

“You don’t impeach a Cupboard secretary over coverage disagreements,” Jayapal stated. “The border isn’t, ‘open.’ No administration has ever had full ‘operational management’ of the border, detained each asylum-seeker, or not used parole in some type.”

Mayorkas grew to become DHS secretary about two weeks after Biden was sworn in as president. Below his management, critics observe, over 6 million unlawful aliens have been encountered on America’s borders. Since fiscal yr 2023 started in Oct. 1, a report 1.8 unlawful aliens have been encountered.

In April 2022, whereas testifying at a Home listening to, Mayorkas was requested by Rep. Chip Roy, R-Texas: “Will you testify beneath oath proper now, do we have now operational management [of the border], sure or no?”

“Sure, we do,” Mayorkas responded.

The definition of operational management isn’t subjective. The Safe Fence Act of 2006 defines operational management as “prevention of all illegal entries into the USA, together with entries by terrorists, different illegal aliens, devices of terrorism, narcotics, and different contraband.”

Biggs first launched articles of impeachment in opposition to Mayorkas in August 2021, when he was chairman of the conservative Home Freedom Caucus. In February, Biggs filed new articles of impeachment in opposition to Mayorkas, saying in a press launch that Mayorkas “is the chief architect of the migration and drug invasion at our southern border.”
