Will Supreme Court Hear Cases on State Gay Marriage Bans?

The U.S. Supreme Court will meet Monday in a closed door session to decide which petitions to hear in the upcoming term. Seven of those petitions address the overturning of state bans on same-sex marriage. Voices on both sides of the issue want a ruling from the Supreme Court on the constitutionality of both the bans themselves and the overturning of those bans.

Decisions at the appellate level so far have agreed with lower court decisions to overturn the bans. According to this U.S. News & World Report article, many believe the Supreme Court may wait until an appeals court reverses the lower court decision and upholds the state ban (which could happen in the 6th circuit).

Although Justice Ruth Bader Ginsburg has recently hinted that the Supreme Court may decide to take up the issue during the upcoming term, she has also warned the court against moving the same-sex marriage issue too quickly through the court system. Ginsburg has suggested that a quick, sweeping decision could result in years of backlash, similar to Roe v. Wade.
